Specific services included in your subscription or purchase depend on the package or service you select.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase or use our services.

If you are purchasing or using our services on behalf of a business, you represent that you have authority to bind that business to these Terms.

You agree to provide accurate and current information when purchasing or using our services.

3. Services

CreoWeb may modify, improve, add, or discontinue features from time to time.

4. Client Responsibilities

You are responsible for providing accurate information, business details, logos, images, content, contact information, service information, and other materials necessary for us to provide the services.

You represent that you have the legal right to provide any content, customer information, contact lists, images, trademarks, or other materials you provide to CreoWeb.

You are responsible for reviewing and approving content, websites, automations, messages, and other materials before they are used for your business.

5. SMS and Messaging Services

If you use CreoWeb's SMS, MMS, missed-call text-back, appointment reminder, lead follow-up, or other messaging services, you agree to comply with all applicable federal, state, and local laws and regulations governing electronic communications.

This includes applicable requirements under the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, A2P 10DLC requirements, carrier policies, and applicable privacy laws.

You are responsible for obtaining any legally required consent before sending messages to your customers, leads, prospects, or other recipients.

You must not use CreoWeb's messaging services to send unsolicited or unauthorized messages, spam, deceptive communications, or messages to individuals who have not provided the required consent.

You must maintain appropriate records demonstrating consent when required.

6. SMS Consent

When you provide your phone number to CreoWeb and separately opt in to receive SMS messages, you consent to receive the types of messages described in the applicable consent disclosure.

Depending on the consent you provide, messages may include:

Appointment reminders

Callback or service notifications

Customer support communications

Lead follow-ups

Service updates

Promotional offers

Discounts

Other business-related communications described at the time of opt-in

Message frequency may vary.

Consent to receive SMS messages is not a condition of purchasing services.

7. SMS Opt-Out

You can cancel SMS communications at any time by replying STOP to a message received from CreoWeb.

After you send STOP, you will receive a confirmation message and will no longer receive SMS messages from that messaging program unless you separately provide consent to receive messages again.

You may also contact CreoWeb directly to request assistance with SMS communications.

8. SMS Help

If you are experiencing issues with CreoWeb's messaging program, reply HELP to a message for assistance.

9. Message and Data Rates

Message and data rates may apply to SMS and MMS messages depending on your mobile carrier and wireless plan.

CreoWeb is not responsible for charges imposed by your wireless carrier.

10. Message Delivery

CreoWeb does not guarantee that every SMS, MMS, voice message, or other communication will be delivered successfully or immediately.

Messages may be delayed, filtered, blocked, or otherwise affected by wireless carriers, network conditions, recipient settings, device compatibility, or other factors outside of CreoWeb's control.

Carriers are not liable for delayed or undelivered messages.

11. Client Responsibility for Messaging Compliance

If you use CreoWeb's communication tools to contact your own customers or leads, you are responsible for your messaging practices.

You agree to:

Obtain all legally required consent before sending messages.

Maintain appropriate records of consent.

Honor STOP and other valid opt-out requests.

Use accurate sender identification.

Follow applicable A2P 10DLC and carrier requirements.

Follow applicable federal and state telemarketing laws.

Avoid sending spam, deceptive, fraudulent, abusive, or unlawful messages.

Use messaging only for lawful business purposes.

CreoWeb may suspend or terminate messaging functionality if we reasonably believe it is being used in violation of applicable law, carrier requirements, or these Terms.

12. Prohibited Uses

You may not use CreoWeb's services to:

Send spam or unsolicited communications.

Send messages without required consent.

Engage in fraudulent or deceptive activity.

Harass, threaten, or abuse recipients.

Promote illegal activities.

Send unlawful or prohibited content.

Circumvent carrier restrictions or messaging safeguards.

Upload malicious software, viruses, or harmful code.

Violate another person's privacy or legal rights.

Violate applicable federal, state, or local laws.

Use our services in any manner prohibited by applicable telecommunications or messaging policies.

CreoWeb reserves the right to suspend or terminate services involved in prohibited activity.

13. Websites and Domains

If CreoWeb builds or manages a website for you, the specific ownership, hosting, domain, and transfer terms will depend on the service or package purchased.

Unless otherwise agreed in writing, CreoWeb may host and maintain websites using our own hosting infrastructure or third-party hosting platforms.

You are responsible for ensuring that information provided for your website is accurate and lawful.

If you provide a domain name, you represent that you have the right to use that domain.

14. Third-Party Services

CreoWeb may use third-party services and platforms to provide portions of our services, including website hosting, CRM, communications, SMS, analytics, artificial intelligence, payment processing, scheduling, and other technology services.

Third-party services may have their own terms, privacy policies, limitations, outages, fees, and requirements.

CreoWeb is not responsible for outages, failures, policy changes, or other issues caused by third-party platforms outside our reasonable control.

15. Payments and Subscriptions

If you purchase a recurring subscription, you authorize CreoWeb or its payment processor to charge your selected payment method for the applicable subscription fees and other authorized charges.

Subscription pricing, billing frequency, included services, and any usage-based charges will be disclosed at the time of purchase or in your applicable service agreement.

Unless otherwise stated in writing, subscriptions automatically renew until canceled.

16. Cancellation

You may cancel a recurring service according to the cancellation process provided by CreoWeb.

Cancellation generally becomes effective at the end of the current paid billing period unless otherwise stated in your service agreement.

Cancellation does not eliminate amounts already owed to CreoWeb.

17. Refunds

Refund eligibility depends on the specific service or package purchased and any refund terms presented to you before purchase.

Because website development, setup, configuration, and other services may begin immediately after purchase, certain services may be non-refundable once work has started.

Any specific refund policy presented at checkout or in a signed service agreement will control if it conflicts with these general Terms.

18. Intellectual Property

CreoWeb retains ownership of its pre-existing software, systems, templates, designs, processes, automation frameworks, technology, code, documentation, and other proprietary materials.

You retain ownership of content, logos, images, trademarks, and other materials that you provide to CreoWeb, subject to the rights necessary for us to provide the services.

You grant CreoWeb permission to use materials you provide solely as reasonably necessary to provide, operate, maintain, and improve the services you have requested.

19. AI Services

Some CreoWeb services may use artificial intelligence or automated systems.

AI-generated responses may contain errors or inaccuracies. You are responsible for reviewing and monitoring automated communications used for your business.

CreoWeb does not guarantee that AI-generated content will always be accurate, complete, appropriate, or error-free.

20. Service Availability

We make reasonable efforts to keep our services available, but we do not guarantee uninterrupted or error-free operation.

Services may occasionally be unavailable due to maintenance, technical issues, third-party outages, network problems, security incidents, or circumstances outside our reasonable control.

21. No Guaranteed Results

CreoWeb does not guarantee any specific number of leads, customers, sales, revenue, search rankings, appointments, reviews, website traffic, or other business results.

Marketing and technology services can improve business processes and customer communication, but results vary based on numerous factors outside our control.

22. Privacy

23. No Sale or Sharing of Mobile Opt-In Data

CreoWeb does not sell or share mobile information collected through SMS opt-in forms with third parties or affiliates for their own marketing or promotional purposes.

Information sharing with subcontractors or service providers may occur when reasonably necessary to provide customer support, communications, hosting, CRM, messaging, or other services.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

24. Account Suspension and Termination

CreoWeb may suspend or terminate access to services if:

You violate these Terms.

You fail to pay amounts owed.

You use the services unlawfully.

Your messaging activity creates significant legal, regulatory, security, or carrier risk.

You provide false or misleading information.

Suspension or termination is required by law or a third-party provider.

Termination does not eliminate amounts that became due before termination.

25. Disclaimer of Warranties

To the maximum extent permitted by law, CreoWeb's services are provided on an "AS IS" and "AS AVAILABLE" basis.

CreoWeb does not guarantee that the services will be uninterrupted, error-free, secure, or free from defects.

To the maximum extent permitted by law, we disclaim warranties not expressly provided in these Terms.

26. Limitation of Liability

To the maximum extent permitted by applicable law, CreoWeb will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, or loss of data arising from or related to the use of our services.

Nothing in these Terms excludes liability that cannot legally be excluded or limited under applicable law.

You agree to defend, indemnify, and hold harmless CreoWeb and its owners, employees, contractors, and service providers from claims, damages, losses, liabilities, penalties, costs, and expenses arising from:

31. Entire Agreement
